These terms and conditions ("Terms") govern your use of the Communage mobile application ("App") and/or Website ("Web") located at https://communage.com/ which is brought to you by Scalybee Digital Private Limited, a private company established under the Indian Law, with its office situated in 4th Floor, B-wing, Kasper Square, Fourth Floor, Gotri - Laxmipura Rd, Vadodara, Gujarat, 390021. The Web and App provides a platform where users can see the events and details of community halls, find and connect with other users within a community in a secure and private way, manage their personal, business, and matrimonial details, and book community halls.
These terms are to be read with Communage’s Privacy Policy. By using the Website and/or App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Web and/or App.
Certain rules are to be abided by while using Communage, which are mentioned in this document, kindly read it carefully. Communage is guided by Indian Laws, incase you are not residing in India, make sure that you comply with the domestic laws.
Use of the Web and/or App
You confirm that you are at least 13 years of age.
You agree to use the Web and/or App only for lawful purposes and in compliance with all applicable laws and regulations.
You agree not to use the Web and/or App in any way that may harm the reputation or interests of Communage or its users.
You agree not to use the Web and/or App to engage in any unethical, fraudulent or illegal activities.
Account Registration
In order to use certain features of the Web and/or App, you must register and create an account.
You agree to provide accurate and complete information during the registration process.
You are responsible for maintaining the confidentiality of your login credentials and notifying Communage via email, support@communage.com immediately if you suspect any unauthorized access or activity in your account.
User Content
You are responsible for any data, text, or other content that you submit or upload to the Web and/or App ("User Content").
You agree that you own or have the necessary rights to use and publish the User Content.
By submitting or uploading User Content, you grant Communage a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to use, reproduce, modify, distribute, and display the User Content in connection with your use of the Web and/or App.
You agree that you will not submit or upload any User Content that is defamatory, obscene, harmful, or violates any applicable laws.
Communage reserves the right to remove any User Content that violates these Terms or is otherwise objectionable.
Violation can be punishable under Indian Law, namely, the IT Act, 2000 and such violations include:
Section 43: damage to computer systems
Section 66: hacking
Section 66D: cheating by impersonation using computer resources
Section 66C: identity theft
Section 66E: violation of privacy
Section 67: publishing or transmitting obscene material in electronic form
Section 67A: publishing or transmitting sexually explicit material in electronic form
Section 67B: publishing or transmitting material depicting children in sexually explicit act in electronic form
But is not just limited to the above sections.
Privacy
Communage takes the privacy and security of its users seriously. Please refer to our Privacy Policy for more information.
Intellectual Property
The Web and/or App and its contents, including but not limited to its logo, design, text, images, and software, are protected by copyright, trademark, and other intellectual property laws.
You agree not to copy, modify, reproduce or distribute any content from the Web and/or App without the express written consent of Communage.
Disclaimer of Warranties
The Web and/or App is provided on an "as is" and "as available" basis. Communage does not guarantee that the Web and/or App will meet your requirements or operate in an error-free, uninterrupted or secure manner.
To the fullest extent permitted by law, Communage disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
You agree that, to the fullest extent permitted by law, Communage will not be liable for any loss, damages, or expenses arising out of or related to your use of the Web and/or App.
In no event will Communage be liable for any indirect, incidental, or consequential damages arising out of or related to these Terms or the Web and/or App.
Termination
Communage may terminate your use of the Web and/or App at any time with or without cause.
Upon termination, your licence to use the Web and/or App will immediately terminate and you must stop using the Web and/or App.
Account Deletion
If you choose to delete your account, Communage shall remove your account from the Web and/or app for you.
However, you can retrieve your account within 30 days of deletion. After the 30th day ceases, your account shall be deleted permanently and the data shall also be removed from the storage.
6 months of inactivity shall lead to the suspension of your account, and therefore, you shall have to contact Communage at support@communage.com for reactivation of the same.
In case you lose access to the credentials of your account, you may contact us to reset the same.
Governing Law
These Terms are governed by and construed in accordance with the laws of India.
Any disputes arising out of or related to these Terms or the Web and/or App will be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
Amendments
These Terms may be amended from time to time.
Any amendments to these Terms will be effective immediately upon their posting on the Web and/or App.
